1. Definitions

"Company", "we", "us", "our" refers to Leigh & Co Beauty, a sole proprietorship owned and operated by Leigh-Anne Jordaan in Cape Town, South Africa.

"Customer", "you", "your" refers to the person accessing or using our website and services.

"Products" or "goods" means any items listed for sale on our website.

"Website" means www.leighcobeauty.com and all associated pages.

"CPA" means the Consumer Protection Act 68 of 2008, as amended.

"POPIA" means the Protection of Personal Information Act 4 of 2013.

2. Account Terms

You must be at least 18 years old to create an account on our website.

You are responsible for maintaining the confidentiality of your account credentials.

You agree to provide accurate, current, and complete information during registration.

We reserve the right to suspend or terminate accounts if we suspect unauthorized use or violation of these terms.

3. Products and Pricing

We strive to display accurate product descriptions, images, and pricing. However:

Product images are for illustrative purposes; actual products may vary slightly.
All prices are in South African Rand (ZAR). Leigh & Co Beauty is not VAT registered, therefore no VAT is charged on any products.
We reserve the right to change prices at any time without prior notice, but changes will not affect orders already placed.
In the event of a pricing error, we will notify you and give you the option to confirm the order at the correct price or cancel it.

While we make every effort to ensure accuracy, product availability and specifications are subject to change without notice.

4. Orders and Payment

Order Acceptance

Placing an order constitutes an offer to purchase our products.
We reserve the right to accept or decline any order for any reason (e.g., stock unavailability, payment failure, suspected fraud).
A binding agreement is formed when we send you an order confirmation email.

Important Payment Information:

We do NOT store your credit card details. All payments are processed by our secure third-party partner PayFast, who is fully POPIA-compliant. Manual EFT payments are processed upon receipt of payment in our bank account.

Order Cancellation

You may cancel your order within 3 days of placement, provided it has not yet been processed for shipping.
To cancel, please contact us immediately at leigh@slimskin.co.za.
Refunds for cancelled orders will be processed within 7-10 business days to the original payment method.

5. Shipping and Delivery

Delivery Areas

We currently ship to all major towns and cities in South Africa. Please contact us for international shipping options.

Standard Shipping: R150 (free for orders over R1000)
Delivery Times: 3-7 business days
Courier Partner: The Courier Guy

Delivery Process

Risk in the goods passes to you upon delivery.
Please inspect your parcel upon delivery and note any damages on the delivery note before signing.
If you are unavailable for delivery, the courier will leave a card with instructions for re-delivery or collection.

Non-Delivery

If your order has not arrived within the estimated timeframe, please contact us with your order number and we will investigate immediately.

6. Returns and Refunds

We want you to be completely satisfied with your purchase. Please review our return policy below:

Return Process

Contact us at leigh@slimskin.co.za with your order number and reason for return.
We will provide a return authorization and instructions.
Pack the item securely in original packaging.
Ship the item back to us (using a trackable method).
Once received and inspected, we'll process your refund within 7-10 business days.

Non-returnable items: Gift cards, sale items (unless damaged), and products marked as "final sale" cannot be returned.

7. Your Rights Under the Consumer Protection Act (CPA)

Nothing in these Terms & Conditions limits your rights under the Consumer Protection Act 68 of 2008. In accordance with the CPA:

Cooling-off period

For transactions concluded online, you have 5 business days to cancel the transaction without reason or penalty, provided the goods have not been used.

Right to fair value and quality

Products must be of good quality, in good working order, and free of defects.

Implied warranty

A 6-month implied warranty applies to all products regarding quality and safety.

Right to fair and honest dealing

Suppliers may not use false, misleading, or deceptive representations.

8. Limitation of Liability

To the fullest extent permitted by South African law:

Our website and products are provided "as is" without warranties of any kind, either express or implied.
We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our products or website.
Our total liability to you for any claim shall not exceed the purchase price of the product giving rise to the claim.
We are not liable for any delay or failure to perform due to circumstances beyond our reasonable control (force majeure).

9. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
